14. Dispute Resolution

You agree that any arbitration shall be conducted on an individual basis and not in a class, consolidated, or representative action. You and Via 313 each waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section shall prevent either party from seeking emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.

14.3 Exceptions to Arbitration

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes or claims within that court's jurisdiction. Additionally, either party may seek emergency injunctive relief from a court of competent jurisdiction to preserve the status quo pending arbitration.

14.4 Time Limitation

To the extent permitted by law, any claim or cause of action you may have arising out of or related to these Terms or the Site must be filed within one (1) year after such claim or cause of action arose, or it shall be forever barred.
